Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and the operator of this site ("we," "us," or "our") governing your access to and use of FICA Tip Credit Calculator at https://www.ficatipcreditcalculator.com (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Informational estimates only
The Service is a free informational screening and worksheet aid. It produces estimates from information you enter and assumptions used by the calculator. It does not provide tax, legal, financial, or accounting advice, and it is not a substitute for advice from a qualified professional who has reviewed your specific facts.
Use of the Service does not create an accountant-client, attorney-client, tax-preparer, fiduciary, or other professional relationship. We are not acting as your accountant, attorney, enrolled agent, financial adviser, or tax-return preparer, and we do not prepare, review, sign, submit, or file any return on your behalf.
Every output is an estimate, not a filed return, and not a promise or guarantee of eligibility, a credit amount, a deduction, tax savings, or any other result. A qualified CPA or tax professional must review the output and all underlying information before you file or rely on it.
2. Eligibility and authority
You may use the Service only if you can form a legally binding contract and are at least 18 years old. If you use it for a business or other organization, you represent that you are authorized to accept these Terms on that organization's behalf, and "you" includes that organization.
3. Your responsibilities
You alone are responsible for:
- the accuracy and completeness of all information you enter;
- determining whether you qualify for the credit under all applicable requirements;
- checking every estimate, assumption, threshold, wage rate, and figure against current law and authoritative sources;
- obtaining qualified professional review before filing or taking a tax position; and
- your filings, elections, positions, deadlines, decisions, and all consequences of using or relying on the Service.
Eligibility depends on facts the Service does not collect or verify, including facts specific to your business, employees, payroll, tax year, and industry. Tax law, tax forms, guidance, thresholds, and federal, state, and local wage rates can change. Information or figures used by the Service may therefore be incomplete or out of date. You must verify the current rules and your circumstances with a qualified tax professional.
4. License and acceptable use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for lawful internal business or personal purposes. You may not:
- use the Service for an unlawful or fraudulent purpose;
- interfere with, disrupt, overload, or attempt unauthorized access to the Service or related systems;
- copy, scrape, data-mine, frame, mirror, resell, or commercially redistribute the Service or its content except as law expressly permits; or
- remove, obscure, or alter any disclaimer or legal notice.
5. Intellectual property
The Service, including its software, design, text, and worksheet layouts, is owned by the operator or its licensors and is protected by applicable intellectual-property laws. Government forms and government materials remain the property or works of their respective authorities. You retain ownership of information you enter.
6. Third-party materials and government references
Links and references to third-party websites, statutes, forms, publications, or other materials are provided only for convenience and identification. We do not control or warrant third-party content, and a link or reference does not constitute an endorsement.
The Service is not affiliated with, endorsed by, sponsored by, or connected to the Internal Revenue Service, the U.S. Department of Labor, or any federal, state, local, or other government agency.
7. United States scope
The Service concerns only U.S. federal tax law, including IRC §45B and IRS Form 8846, and U.S. federal and state wage rules. It has no application to the tax law of any other country.
The Service is intended for use by U.S. businesses and their advisers. It is not directed at or intended for users in the European Union, European Economic Area, or United Kingdom, and it is not offered or marketed to them.
Anyone who chooses to access the Service from outside the United States does so on their own initiative and is responsible for complying with their own local laws. Nothing on the Service is an offer or solicitation directed to any person in a jurisdiction where that offer or solicitation would be unlawful.
8. No warranties
To the fullest extent permitted by law, the Service and all content and outputs are provided "as is" and "as available," without warranties of any kind, express, implied, or statutory.
We disclaim all warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, currency, availability, security, and reliability. We do not warrant that the Service will be uninterrupted or error-free, that defects will be corrected, or that any estimate, calculation, assumption, worksheet, wage rate, threshold, or other information is accurate, complete, current, suitable for filing, or fit for your circumstances or any particular purpose.
9. Limitation of liability
To the fullest extent permitted by law, the operator and any contributors, licensors, or service providers will not be liable for any loss, claim, tax, assessment, penalty, interest, damage, cost, or expense arising from or related to the Service, your inability to use it, or your use of or reliance on any content or output.
This exclusion includes direct, indirect, incidental, consequential, special, exemplary, and punitive damages; loss of profits, revenue, business, goodwill, data, tax benefits, deductions, credits, or opportunities; filing errors or delays; and the cost of substitute professional services, even if the possibility of loss was known or foreseeable. To the fullest extent permitted by law, total aggregate liability for all claims relating to the Service will not exceed USD 50.
Nothing in these Terms excludes or limits liability that applicable law does not permit to be excluded or limited. Where an exclusion or limitation is not enforceable, liability is limited to the greatest extent permitted by law.
10. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless the operator and its contributors, licensors, and service providers from claims, liabilities, damages, losses, and reasonable costs and expenses arising from your misuse of the Service, violation of these Terms or law, data you enter, or tax filings, positions, or decisions.
11. Privacy
Use of the Service is also subject to the Privacy notice, which describes how data is handled.
12. Changes, suspension, and termination
We may change, suspend, restrict, or discontinue any part of the Service at any time without notice or liability. We may update these Terms by posting a revised version and changing the effective date. Your continued use after revised Terms take effect constitutes acceptance. We may suspend or terminate access for a violation of these Terms or to comply with law.
13. General
These Terms and the Privacy notice constitute the entire agreement concerning the Service. If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary and the remaining provisions will remain in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without consent; the operator may assign them in connection with a transfer of the Service. Headings are for convenience only. Sections that by their nature should survive termination will survive.
